Limitation of Liability

To the extent permitted by law, in no event shall either we nor any other party involved in creating, producing or delivering the Site or any Content be liable for any special, incidental, consequential or indirect damages or any damages whatsoever, including but not limited to damages resulting from the loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to or use of, or inability to access or use the Site and the Content, whether based on warranty, contract, tort, negligence or any other legal theory, and whether or not we know of the possibility of such damage.

3. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with paragraph (a) or (b) but allows a limitation of a certain maximum extent, then our liability is limited to that extent.
   

Cancellation

1. You may cancel your registration at any time by notifying us.

2. We may cancel your registration if you do not visit the Site for an extended period of time, or if we reasonably believe that you have violated any Applicable Laws, acted inconsistently with the letter or spirit of this agreement or violated our rights or those of another party.

3. The provisions of this agreement entitled "Disclaimer", "Limitation of Liability" and "General Provisions" will survive cancellation of your registration or termination of this agreement.

Governing Law and Jurisdiction

1. Any goods and/or services offered and/or activities and/or events promoted or launched through the Site are strictly for our customers in the Republic of Singapore. Nothing in the Site is to be construed as our providing goods and/or services and/or promoting or launching of activities and/or events outside of the Republic of Singapore.

2. The Site can be accessed from all countries around the world where the local technology permits. As each of these places has differing laws, by accessing the Site both you and us irrevocably agree that :-

   1. the statutes and laws of the Republic of Singapore will apply to all matters relating to the use and access of the Site;
   2. this agreement will be governed by the statutes and laws of the Republic of Singapore; and
   3. you agree to submit to the exclusive jurisdiction of the courts of the Republic of Singapore.
      

General Provisions

1. If any part of this agreement is held to be or becomes unenforceable, illegal or invalid for any reason, such unenforceable, illegal or invalid part(s) will be deemed to be severed from this agreement, and the remainder will remain in full force and effect.

2. You agree to indemnify and to hold us, our officers, directors, employees and agents harmless from and against any claim, action, demand, loss, damage, liability proceeding and or expense suffered or incurred by us resulting from or which is related to your use of the Site or the Content or your breach of this agreement.

3. We may appoint agents, assign or sub-contract the whole or any part of our rights and/or obligations contained in this agreement to any person at any time.

4. If we do not exercise any right or remedy under this agreement, this does not mean that they have been waived.
   

Definitions

"Applicable Law" in relation to any person, action or thing means the following in relation to that person, action or thing:

1. any law, rule or regulation of any country (or political sub-division of a country);
2. any obligation under any licence in any country (or political sub-division of a country); and
3. any lawful and binding determination, decision or direction of a regulator in any country (or political sub-division of a country).

   "Content" includes things that you may see, read, hear, download or access on or via the Site (including but not limited to messages, files, data, software, images, photographs, illustrations, text and other materials)

   "We" or "us" means Jardine OneSolution (2001) Pte Ltd.
